How to register electronic media
At the moment, all Internet resources, regardless of their audience, are not required to register as a mass medium, but the definition of “electronic media” has already appeared in the law, which just means sites that operate in the media format. Only a site can become a media outlet not by the law of its work, but only after registration with the Federal Service for Supervision in the Sphere of Communications, Information Technologies and Mass Communications. That is, the definition of electronic media in Russia today is formal, and not according to the fact of information disseminated by the resource.
However, there is a trend that can greatly change the usual order of things. So in 2014, the government decided to introduce control over the activities of unfortunate bloggers, whose number of page visits exceeds 3,000 per day, and in the spring of 2015 there was a proposal to equate all sites with high traffic to the media. And attendance becomes the determining factor, and not the subject, for example. The initiator of this innovation was even named a figure – 10 thousand views obliges the site to be registered as a mass media. It is not yet known whether such a law will be adopted, but it’s worth now to think about the need to register your electronic media. In addition, it may even give its advantages. Or bring new problems to your activity – as luck would have it in this country, which is trying with all its might to limit freedom of speech.
In general, this information will be useful to those entrepreneurs (and not only entrepreneurs) who keep their popular website, and those who are only going to create their own portal on the Internet. First you need to decide how the media defines the law, or rather, what is needed in order to fall under this definition. Media is any form of periodic distribution of mass information under a certain unchanging name. But very many publications fit this definition, but not everybody is obliged to register as media. There are no clear definitions for websites that allow classifying them as a mass media, the proposal for the number of views is still just a statement, and this law has not even been submitted for discussion. In this regard, the electronic media differs from the “usual” only in that it disseminates information directly on the Internet. This form of media is called a network publication. Therefore, the requirements for registration fully coincide with those of other types of media. There are, of course, some features in the registration procedure, but in general the whole process is similar to that during the registration of your TV channel, for example, or a radio station. Let’s stop a little more in detail.
So, the media can be registered by a legal entity or an individual, as well as their associations. That is, several individual entrepreneurs, a group of citizens, any association or union can open the media. The media is in some way an independent form, it is rather even a tool, and not a subject of entrepreneurial or other activity. Restrictions, however, there is here. For example, a person without citizenship who is not permanently residing in the territory of the Russian Federation, as well as a citizen of another state, cannot become a founder.
By the way, besides the need to introduce compulsory registration of sites with high attendance as media, there is talk of restricting the financing of Russian media from abroad. Sites that enjoy foreign support are encouraged to assign the status of “media – a foreign agent.”
In the media being formed there must be an editorial board, which from a professional point of view is an independent unit. That is, the editorial board determines the format of work, the subject matter, is engaged in the activities of its media in general, and the founder is very limited in his rights. True, in spite of the fact that the law really has more rights transferred to the editorial board headed by the chief editor, the parties are often guided by the Charter, which must be written (no one will register the media without it) and the contract. It should be noted that the editors can act as the founder of the media, that is, to be a completely separate entity. In general, the editorial staff really has a lot of opportunities.
As already noted, the Charter of the Editorial Board of Mass Media is being created, in accordance with which the work of the publication will take place, but in its activities the media is also guided by the Law of the Russian Federation “On Mass Media” and the agreement with the founders.
